Quotations are provided subject to availability, conflicts, the nature of the instructions received, and acceptance of instructions on Racheal Muldoon's published terms of engagement.

To enable a quotation to be provided, prospective clients should provide, where possible:

  • A short description of the matter

  • The current procedural stage

  • The work required, for example: advice, drafting, conference, or advocacy

  • Any material deadlines or urgent timetable

  • Copies of core documents, where available

A quotation can only be indicative unless and until sufficient information and papers have been provided.

Pricing Models

Racheal Muldoon's most commonly used pricing models are:

  • Fixed fees for discrete pieces of work with a clearly defined scope

  • Hourly rates where the scope of work is uncertain, document-heavy, or likely to develop

  • Brief fees and refresher fees for hearings, trials, or other substantive advocacy, where applicable

  • Staged fees where a matter can sensibly be divided into separate phases

The fee structure for any matter will depend on:

  • The scope and complexity of the work

  • Urgency and whether expedited turnaround is required

  • The volume of papers

  • The number of parties involved

  • The value and importance of the issues

  • The level of seniority and specialist expertise required

  • Whether advocacy is required

Timescales will depend on many of the same factors, together with:

  • Court, tribunal, arbitral, or mediation timetables

  • The prompt provision of instructions and papers

  • Whether the scope of work changes after instruction

What a Quotation Will Include

Where a quotation is provided, it will usually identify:

  • The scope of work covered

  • The basis of charging (for example: fixed fee, hourly rate, brief fee, refresher fee, or staged fee)

  • Whether VAT is included or payable in addition, where applicable

  • Any likely third-party costs or disbursements, such as court fees, transcript fees, travel, accommodation, courier charges, expert fees, interpreters, or hearing bundle costs, and whether those costs are estimates only

  • The assumptions on which the quotation is based

  • The circumstances in which the quotation may need to be revised, including material changes in scope, volume of documents, timetable, hearing length, complexity, or additional work requested after the original quotation

Payment and Credit Position

Unless otherwise agreed in writing, quotations are not binding until instructions are accepted. Fee arrangements, invoicing arrangements, payment responsibility, and the applicable contractual terms will be confirmed on acceptance of instructions or in the relevant client care and engagement documentation.

For professional and licensed access instructions, work is ordinarily accepted on published contractual terms which identify the basis on which fees are payable. Where work is undertaken through a professional client or licensed access client, quotations will make clear whether fees are payable by that client irrespective of whether they have themselves been put in funds, or on some other agreed basis.

Racheal Muldoon reserves the right to:

  • Require payment on account

  • Require staged payments

  • Require payment before delivery of final work product

  • Require payment before a hearing

This is particularly the case in urgent matters, document-heavy matters, matters involving a new client relationship, or where there are reasonable credit concerns. Interest and recovery costs may be charged on overdue sums where permitted by the applicable contractual terms and law.
